To be arrested for DUI in California, a person 21 years or older must have a blood alcohol concentration (BAC) of 0.08% or higher. You can also be arrested for having an open container of alcohol in your vehicle, though sealed containers of alcohol are acceptable if you are of legal drinking age. However, if you are underage, your BAC only has to be 0.01% for you to be legally arrested. Also, you may not have any kind of alcohol in your vehicle, open or sealed. The only exception is if you are accompanied by a parent or guardian, or if you are on the job and transporting sealed containers of alcohol for an employer who is licensed to sell alcohol.
Keep in mind that police officers must follow strict procedures in order to make a lawful DUI arrest. There must be plausible cause for them to pull your child over and, if they suspect he or she has been drinking, they must ask your child to perform field sobriety tests. If he or she fails one or more of these tests, the officer may ask them to submit to a
