We have worried clients call us all the time asking what are they looking at punishment wise with regards to their DUI offenses. On a standard first time DUI it's possible you could be looking at up to six months in jail. Is that likely? Probably not. The way we evaluate the cases is to determine one whether or not the case is going to be filed as a misdemeanor or felony. The way we do that is by determining whether or not there was an accident involved or whether or not you have had prior DUI convictions in the past. Obviously the more convictions you have had in the past or if there are any injuries or automobile accidents while you're driving under the influence are going to affect the exposure that you're looking at.
