In California, this is technically termed 'sexual exploitation of a minor.'  Merely possessing or downloading a picture depicting someone under 18 engaged in sexually exploitative behavior fits this charge.  Further, the law does not differentiate whether or not the photograph depicts a real person, which is why you need a child pornography attorney with experience.
