DUI Charges in San Francisco – What Can You Expect?

Firstly, when you have been arrested and charged with driving under the influence of alcohol or drugs, you should seek expert legal representation from an esteemed San Francisco criminal defense attorney immediately. An experienced lawyer from Okabe & Haushalter will fight tooth and nail to obtain the best possible outcome from your case, and will leave no stone unturned in our investigations.

Hiring an attorney immediately can have multiple benefits for your case, including the legal guidance and support you need to avoid incriminating yourself further while speaking to police after the incident. Without a highly skilled criminal defense attorney by your side, you are likely to face the maximum possible charges for DUI and, where injury has been caused, this may be considered either a misdemeanor or a felony. If the judge decides that your offense constitutes a felony, you could be sentenced to three years in state prison. For a felony resulting in great bodily injury, you could also receive an additional three years imprisonment, plus a strike on your criminal record under California’s Three Strike Rule.

As you can see, the potential consequences of your actions are severe and you could make the situation significantly worse for yourself by failing to appoint a suitably-experienced San Francisco criminal defense attorney.

How Your San Francisco Criminal Defense Attorney Can Help Minimize Penalties

While each DUI case will be different to the next in some way or another, there are some similarities common across all cases of driving under the influence. For one, your San Francisco criminal defense attorney, while representing you, must prove that:

  • You did not cause the accident in question
  • Your driving abilities were not impaired at the time of the accident
  • Your blood alcohol concentration was within the legal limits at the time of the accident

Your defense attorney could also rely on factors such as road conditions, weather conditions, or mechanical failure, as the deciding factor in a DUI charge will lie in whether or not you caused the collision. We will use accident reconstruction, independent investigators, and your blood or breath test results to build the strongest possible case on your behalf.
