What Is A Felony DUI?

Most often, a typical driving under the influence offense with no aggravating factors will be charged as a misdemeanor, and the maximum penalty is up to 12 months in county jail.   • Felony DUI manslaughter: up to 4 years in state prison
  • With gross negligence: up to 10 years in state prison
