Under California law, pimping and pandering are two separate charges that both carry very serious penalties. Penal code 266h (a) defines pimping as knowingly living off of or gaining financial support from the earnings or proceeds of another person’s prostitution, no matter if they solicit customers or collect the earnings without finding customers.

A person can be charged with pandering under penal code 266i for procuring someone else for the purpose of prostitution, forcing another person to become a prostitute, procuring a place for prostitution to occur, forcing someone to remain as a prostitute, procuring someone else to become a prostitute in the state through fraud or threat, or accepting money or giving money for procuring or attempting to procure someone to enter or leave the state to be a prostitute.

What Are The Penalties For Pimping And Pandering?

Pimping Penalties

  • The crime of pimping is a felony offense, and the consequences can vary depending on the circumstances.
  • Incarceration in state prison for 3 to 6 years, and possible fines up to $5,000
  • If the person being prostituted is a minor, the defendant faces incarceration in a state prison for 3 to 8 years and fines up to $15,000

Pandering Penalties

  • Pandering is a felony, and sentencing will depend upon the specifics of the offense.
  • Incarceration in state prison for 3 to 6 years
  • If the individual being pandered is a minor, the defendant could be sentenced to incarceration in state prison for 3 to 8 years and fines up to $15,000
