A Simple assault is considered a Class C misdemeanor which carries potential penalties of 30 days in jail, a $1,500 fine or both. Aggravated assault is more complex depending on how the prosecutor charged the offense as either a Class A misdemeanor or a Class 4 felony. For a Class A misdemeanor, defendants may face up to one year in prison, a $2,500 fine or both. Class 4 felony charges can lead to one to three years in prison, a $25,000 fine or both. The battery also has additional penalties that can be added on top of assault penalties. The battery is considered a Class A misdemeanor and aggravated battery is a Class 3 felony. Class 3 felonies can result in a two to five year prison sentence.
