Chicago Drug Crime Attorney

With drugs on the rise in Chicago streets, anyone can be caught for possession even unintentionally, the drugs may be planted on you by someone on the run. Sometimes the cops think that something is a substance when in reality it is something harmless. For example, there was a case of a man who was driving home from work and was pulled over. The cops found a white substance and thought it was cocaine. The man was immediately detained and had to spend several days in jail. They later found out the substance was actually powder from a donut the man had earlier in the week. It sounds like a unique situation but it isn’t. Cops try to meet quotas for the month and will add charges where there are none. If you have found yourself in a situation where you are facing drug charges, contact our drug crimes attorneys for a case evaluation.

Types of Drugs Crimes

Drug charges are serious offenses in Illinois and judges do not often show much sympathy. Possession of any amount of Heroin, Cocaine, LSD, or Morphine are all illegal and are considered Class 1 felonies. Smaller amounts of possession result in lower sentences while larger amounts carry more severe consequences. Aside from illegal substances, there are also Anabolic Steroid possession charges. Steroid possession is a Class C misdemeanor with a maximum of 30 days in jail and up to $1,500 fine.

Illinois Laws and Punishments

There are two main types of drug crimes including possession and sale. They can carry felony or misdemeanor charges. For students who are convicted of either, they will not be able to receive student aid. Drug possession varies by the drug and how many grams you had. Cannabis possession has a potential fine of $1,500 and 30 days in jail for 2.5 grams and can be as steep as a $25,000 fine with up to 15 years in the penitentiary. Possession of drug paraphernalia has a fine of $750 to $2,500 or up to one year in jail. A first offense prescription forgery has a fine of up to $100,000 or 3 years in jail. Heroin, Cocaine, Morphine, LSD, Lysergic and Methamphetamine possession carries felony charges of a $200,000 fine and up to 15 years in a penitentiary for 15 to 100 grams. Anything over 900 grams can carry a similar fine and up to 50 years in a penitentiary.

Sale of, manufacturing, and possession with intent to traffic drugs can carry harsher penalties. For cannabis, it can be a $1,500 fine and 6 months in jail for 2.5 grams. Other drugs like cocaine, heroin, meth and morphine have felony charges with a $250,000 fine and up to 15 years in prison. Illinois has an enhancement that if the possession or sale happens within 1500 feet of a school, church, theatre or park the fines and sentencing may be doubled. This also applies if there was a firearm involved.
